What Wyoming law requires

Wyoming's ignition interlock, SR-22, and reinstatement rules are set by the statute and agency rules cited below. The values in the tables on this page are taken from those sources and are not interpretations of how they apply to any particular case.

Ignition interlock requirement

Under Wyo. Stat. § 31-5-233(f)(ii), a first conviction (or deferred prosecution under § 7-13-301) requires operating only vehicles equipped with an ignition interlock device for six months where the department's administrative action indicates an alcohol concentration of 0.15% or more. Threshold: 0.15%. WYDOT states the requirement applies to a first DUI conviction with a BAC of .15 or above and to any second or subsequent conviction regardless of BAC. Under § 31-5-233(n) the court may substitute or add a 24/7 sobriety program.

SR-22 requirement

An SR-22 is a certificate an insurer files with the state to confirm that a driver carries the liability coverage the state requires. Some states use an FR-44 or a different form for alcohol-related offenses; where Wyoming does, the sources below say so.

SR-22 (not FR-44). WYDOT's interlock page requires the driver to file SR-22 insurance with the Department before an ignition interlock restricted (IIR) license is issued, and Wyo. Stat. § 31-7-402(c)(vi) requires an IIR applicant to file and maintain proof of financial responsibility for the period of the restricted license. Under § 31-7-128(e) a suspended driver must file and maintain proof of financial responsibility for a three-year period beginning on the date of suspension; § 31-7-127(c) imposes the same three-year requirement after a revocation; § 31-9-401(e) sets the general three-year maintenance period.

When does Wyoming require an ignition interlock after a DUI?

Under Wyo. Stat. § 31-5-233(f), a first conviction where the department's administrative action shows an alcohol concentration of 0.15% or more requires an ignition interlock for six months; a second conviction requires one year; a third requires two years; and a fourth or subsequent conviction requires it for the remainder of the offender's life, with the option to apply to the court for removal after five years.

How does a person get an ignition interlock restricted license in Wyoming?

WYDOT states that after notification of an interlock requirement the driver must have a Wyoming-approved device installed by a Wyoming-certified technician at an approved service center, provide the installation certificate to the Department, file SR-22 insurance, apply for a special IIR restricted license, and pay the $50 reinstatement fee, the regular driver license fee, and the $100 ignition interlock administrative fee. The interlock time does not start until the IIR license is issued.

What is Wyoming's license reinstatement fee after a DUI suspension?

Wyo. Stat. § 31-7-113(e) provides that if a driver's license is reinstated after a period of suspension or revocation, the reinstatement fee is $50 (unless the department's action is reversed). WYDOT's reinstatement page states that Wyoming law requires a $50 reinstatement fee for all suspensions, except child-support suspensions, which carry a $5 fee.

Is there financial assistance for the interlock in Wyoming?

Under Wyo. Stat. § 31-7-401(b)(vii), indigent persons required to use an interlock may have one-half of the costs of obtaining and using the device paid from state funds; a person is considered indigent if eligible and qualified for the federal Supplemental Nutrition Assistance Program. WYDOT states the $100 ignition interlock administrative fee is not required if the assistance application is approved.
